1. Status of the service

Swotly has not yet launched. This website is a launch waitlist: joining it costs nothing, takes no payment and creates no subscription. These subscription terms describe how a Swotly subscription will work when the service opens. They will remain published here and will be re-issued in their final form before the service launches.

2. What a Swotly subscription is

A Swotly subscription gives a learner access to the Swotly study platform: spaced-repetition practice, past examination papers with attribution, a study calendar that adapts to the learner, and the study-wellbeing content that ships with the platform. One subject is available free of charge. A paid subscription opens the full subject set and the paid features.

3. Who the subscription is for

  • Subscriptions are taken out for a named learner in Grades 8 to 12.
  • Where the learner is under 18, the subscription is concluded by a parent or legal guardian, who is the contracting party and the account holder.
  • One subscription may be used by the named learner only. Sharing account access or reselling access is not permitted.

4. Billing frequency

All prices are quoted inclusive of value-added tax. Payment is collected by our payment provider, PayFast, and the subscription is activated once the payment is confirmed. Payment card details are held by the payment provider and are never held by Swotly.

5. Renewal and cancellation

  • A monthly subscription renews automatically each month until it is cancelled.
  • An annual subscription runs to the end of the academic year for which it was billed and does not renew automatically without notice to you beforehand.
  • You may cancel at any time by emailing info@swotly.co.za from the address on the account.
  • Refunds and cooling-off rights are set out in the Refund and Cancellation Policy published on this site.

6. Price changes

We will tell you in writing before any price change takes effect, and no price change will apply to a period you have already paid for. If you do not wish to continue at the new price you may cancel before the change takes effect, on the terms in the Refund and Cancellation Policy.

7. Teacher referral

Teachers who refer learners to Swotly earn a referral commission of R100 per learner per month for as long as that learner subscribes. The commission is funded from the Teacher subscription tier and is paid by Swotly to the teacher from Swotly's own revenue. It is not a payment made on behalf of a learner or a parent, and it does not change what a learner or parent pays. The commission is paid directly by Swotly; no learner, parent or third party holds, receives or forwards any funds on behalf of another person.

8. Access, availability and fair use

  • Access is provided to the named learner for the period paid for.
  • You need a working internet connection and a supported device. Data costs are yours.
  • We may suspend or end access where these terms are broken, where access is shared, or where the platform is abused. Where we suspend access for a reason that is not your fault, the unused portion of the period is refunded.
  • Swotly is a study aid. It is not a promise of marks, and it is not endorsed by the Department of Basic Education or by the Independent Examinations Board.

9. Your personal information

Personal information is processed in accordance with the Protection of Personal Information Act 4 of 2013 and the Privacy Policy published on this site. You may ask for your information, or for its deletion, by writing to info@swotly.co.za. A data deletion page is published on this site.

10. The law that applies

These terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 and the Protection of Personal Information Act 4 of 2013. Nothing in these terms limits a right you have under those laws.
