We are the responsible party for your personal information under the Protection of Personal Information Act (POPIA).

This page covers the Swotly website and the Swotly WhatsApp channel. When this page says "we", it means Swotly.

Your right

Under POPIA you have the right to ask us to delete the personal information we hold about you. For the website that includes the email address you gave us when you joined the launch waitlist. For the WhatsApp channel it includes your chat history, the media you sent us, and the voice notes tied to your number. You do not need a reason.

How to ask

The direct channel is email:

Tell us the email address or phone number you used, so we can find your records. If you are asking for someone else, tell us who you are acting for, and we may ask you to confirm that you are allowed to act for them.

What happens next

We confirm that we received your request within a few days, and we check that it is really you. To check, we reply to the email address or WhatsApp number on file and ask you to confirm. Where you contacted us on WhatsApp, we may ask for a recent message from the number you used. We respond to your request within 30 days, and we delete your data within 30 days of confirming it is really you. We email you to confirm that the deletion is done. Most deletions are done sooner.

What we delete

Your chat messages with Swotly on the WhatsApp channel, and the messages we sent you. Media you shared in the chat, such as images, documents and voice notes, where we hold copies. Your email address, if you joined the launch waitlist. Anything else tied to you that the law does not require us to keep.

The Swotly WhatsApp channel runs on infrastructure operated by BonCor, which owns Swotly. Chat history, media and voice notes are held on that infrastructure. When you ask us to delete, we remove the copies we hold there.

What we keep

We keep the minimum the law requires, such as payment and tax records, for the period the law sets. Tax records we keep for five years, as tax law requires. When that period ends, we delete those too. If a court or regulator requires us to keep something, we keep only that.

We cannot delete copies that other parties hold in their own right. WhatsApp (Meta) keeps message history under its own policy: message history on the WhatsApp Business API is retained per Meta policy and is deleted on request through Meta's channel. The deletion you ask us for covers our copies. For the copies Meta holds, use the deletion channel Meta provides.

After deletion

Once your data is deleted, we cannot restore it. Your chat history with Swotly is gone, and waitlist emails to your address stop. If you want to use a Swotly service again, you sign up again.
