1. Status of the service
Swotly, the study platform for South African learners in Grades 8 to 12, has not yet launched. This website is a launch waitlist. Joining the waitlist costs nothing, takes no payment and creates no subscription. No payment of any kind is collected through this website at present, and therefore no refund can arise from it.
This policy sets out how refunds and cancellations will work once the Swotly subscription is available and payments are being collected. It will remain published on this site and will be re-issued in its final form before the service opens.
2. Cancelling a subscription
- You may cancel your Swotly subscription at any time by emailing info@swotly.co.za from the address on the account.
- Cancellation takes effect on the date you give notice. You will not be charged again for any billing period that begins after that date.
- If you cancel mid-period, your access continues to the end of the period you have already paid for, unless you ask us to end it sooner and we are able to do so.
- A fixed-term subscription may be cancelled on 20 business days' written notice, as provided in section 14 of the Consumer Protection Act 68 of 2008.
- A subscription taken out online may be cancelled within seven days of the date it was concluded, without reason and without penalty, as provided in section 44 of the Electronic Communications and Transactions Act 25 of 2002.
3. Refunds
- Where you cancel within the seven-day cooling-off period, you receive a full refund of the amount paid.
- Where you cancel a paid period after the cooling-off period, any unused portion of that period is refunded on a daily pro-rata basis over the ten-month academic year for which it was billed.
- Where Swotly is unable to provide the service you paid for, you receive a pro-rata refund of the unused portion without deduction.
- Swotly does not use a blanket no-refund term on an annual subscription, because such a term is not enforceable in South African law.
- Refunds are made to the same payment method that was used for the original payment. Where the original payment was made through PayFast, the refund is processed through PayFast.
- We aim to process a refund within 10 business days of approving it. The time before the money reflects is set by your bank or payment provider.
4. How to ask for a refund
Email info@swotly.co.za with the email address on the account, the date of payment and the reason for the request. We reply to every refund request, and we will tell you the outcome and the amount in writing.
5. If something is charged in error
Tell us at info@swotly.co.za as soon as you notice it. A charge that was made in error, or that you did not authorise, is refunded in full.
6. Your rights and the law that applies
- This policy is governed by the laws of the Republic of South Africa.
- The Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002 apply to this service.
- Nothing in this policy limits a right you have under the Consumer Protection Act or any other law.
